1. Copyright Bestpractice.com.au Pty Limited.
Best Practice subscribers are entitled upon payment of the subscription fee to receive Foundation Services (See condition 7. hereof). None of these Foundation Services may be sold, copied, circulated, lent or reproduced in any way other than for internal use within the subscriber's own real estate agency business without the prior written permission of Bestpractice.com.au Pty Limited of P.O. Box 404, Springwood NSW, Australia 2777 who holds the unrestricted worldwide ownership and copyright rights.

2. Approval To Use Materials.
Best Practice subscribers may use sections of The Real Estate Agency Best Practice Bulletin in their own personal business newsletters, marketing materials and news releases provided the source is acknowledged. e.g. Source: The Real Estate Agency Best Practice Bulletin No. 108.

3. Kindred Industries and Professions.
Best Practice subscribers from kindred industries and professions (including but not limited to banks, solicitors, accountants, trainers, computer hardware / software suppliers, valuers, franchisors, marketing groups, listing groups, management consultants, referral groups and the suppliers of goods and services to real estate agency businesses) receive the Foundation Services for their personal information only. Best Practice Foundation Services are provided to kindred industries and professions so that the may be aware of the information being provided by Best Practice to its subscribers for use within their (i.e the subscribers) agency businesses e.g. (i) Franchisor subscribers may not circulate copies to their franchisees nor to any regional or branch office personnel who should be subscribers in their own right. (ii) Computer software suppliers may not lend copies to their users. (iii) Trainers may not distribute copies to their students or co-trainers.

4. Subscription Refusal or Cancellation.
Bestpractice.com.au Pty Ltd reserves the right at its absolute discretion to refuse any request for subscription and the right to cancel any subscription where it believes that decision is in the best general interests of the majority of Best Practice subscribers. Its right to refuse or to cancel shall be final and no correspondence shall be entered into. Where a subscription is cancelled the balance of any subscription fee paid in advance shall be refunded.

5. Subscription Rights and Privileges
Best Practice subscribers are entitled to certain subscriber privileges such as the right to receive, at no additional cost, various Best Practice Products as listed in the Product Inventory. It is a condition of subscription that these privileges are only available where the subscription fee is paid at least one calendar month in advance.

6. Legal Action For Breaches
Any person, company or entity who breaches these copyright conditions either as the supplier or receiver of non authorised material may have legal action taken against them for amongst other things breach of copyright and theft of intellectual property.

7. Foundation Services
Best Practice Foundation Services are those products and services as listed from time to time on the Best Practice website: www.bestpractice.com.au. Bestpractice.com.au Pty Ltd reserves the right at its absolute discretion to add, vary or delete any services or products provided to subscribers and to vary the subscription fee payable for those services and products.

8. Subscription Terms and Fees

(a)

Subscription to Best Practice shall be for an initial term of twelve months whereupon the subscription shall be on a monthly holding over basis. The subscription fee is payable at least one month in advance at all times. The subscription is payable on the 15th day of each month (or nearest business day thereto).

(b)

The Subscription fee is adjusted in July each year to reflect, amongst other things, variations in the costs of delivering products and services to subscribers. The adjusted fee is payable by all subscribers including those who are within the first twelve months of their subscription term.
